Vietnamese French woman files dioxin lawsuit against 35 US companies

A French woman of Vietnamese origin, Tran To Nga, has stood as the sole plaintiff in the Agent Orange/Dioxin lawsuit against 35 chemical companies based in the U.S. for producing the toxic substances sprayed in Vietnam in the 1960s and 1970s.
Her 31-page complaint was sent to the Superior Court (tribunal de grande instance) based in Evry in the southern suburb of Paris, France. In May, the court sent notifications to the 35 defendants in the U.S. about the case.

State Supreme Court upholds Monsanto pollution settlement with Nitro

The approval of a settlement in a lawsuit over pollution of the community of Nitro with dioxin from the former Monsanto chemical plant has been upheld by the state Supreme Court.

By a 4-1 vote Friday, the High Court affirmed a January ruling made by Circuit Judge Derek Swope in the case.

Swope approved the class-action settlement which was meant to resolve long-standing allegations that Monsanto had contaminated Nitro with toxic pollution from the production of the defoliant Agent Orange.

Monsanto Lawsuits: New date set for Monsanto trial

Trial date for a class-action lawsuit against chemical company Monsanto has been reset for January.

The plaintiffs in the case are thousands of current and former Nitro residents who claim that Monsanto polluted their town during the days when it made the Vietnam-era defoliant Agent Orange at a nearby facility.
The lawsuit seeks medical monitoring for at least 5,000 -- and perhaps as many as 80,000 -- current and former Nitro residents.

Charleston lawyer Stuart Calwell alleges in the class-action case, filed in 2004, that Monsanto unsafely burned dioxin wastes and spread contaminated soot and dust across the town, polluting homes with unsafe levels of the chemical.

For more than 50 years, the former Monsanto plant in Nitro churned out herbicides, rubber products and other chemicals. The plant's production of Agent Orange created dioxin as a toxic chemical byproduct.
Dioxin has been linked to cancer, birth defects, learning disabilities endometriosis, infertility and suppressed immune functions. The chemical builds up in tissue over time, meaning that even a small exposure can accumulate to dangerous levels.

Monsanto Lawsuit: Putnam judge has Lou Gehrig's disease

Less than two weeks before a major toxic chemical trial against Monsanto Co., a veteran Putnam County judge on Friday stepped down from the case after being diagnosed with a progressive neurological disease.

In the case, current and former Nitro residents allege that Monsanto polluted the entire town with dangerous amounts of dioxin.

For more than 50 years, the former Monsanto plant in Nitro churned out herbicides, rubber products and other chemicals. The plant's production of the powerful Vietnam-era herbicide Agent Orange created dioxin as a toxic chemical byproduct.

Monsanto Lawsuits: Groups seek ban in 8 Southern states on genetically-modified crops in federal wildlife refuges

Three environmental groups filed a lawsuit Thursday seeking to stop the planting of genetically-modified crops on 44,000 acres of federal land in the South, but the U.S. Fish and Wildlife Service says the corn, milo and rice provide food for migrating birds along critical flyways.

The Center for Food Safety and two other groups argue that the Fish and Wildlife Service did not proper procedures in permitting farmers to grow on the public lands in a program that began 14 years ago. Their suit seeks an injunction that would agree that Fish and Wildlife violated rules and would order a halt to the planting.

Family Farmers Amplify Legal Complaint Against Monsanto's GMOs

Family Farmers Amplify Legal Complaint Against Monsanto's GMOs

FOR IMMEDIATE RELEASE

"Our clients don't want a fight with Monsanto, they merely want to be protected from the threat that they will be contaminated by Monsanto's genetically modified seed and then accused of patent infringement," said PUBPAT Executive Director Daniel B. Ravicher. "We asked Monsanto to give our clients reassurances they wouldn't do such a thing, and in response Monsanto chose to instead reiterate the same implicit threat to organic agriculture that it has made in the past."

Plaintiff Don Patterson added, "With the Monsanto letter, signed by Waxman, the company rolled out their biggest legal cannon but they fired off only fluffy wadding and smoke. The letter shows Monsanto wanting to protect their freedom to threaten farmers with patent infringement suits. Both the threats and the suits seem to be an important part of their marketing strategy and business model they do not want to give up, despite their empty propaganda to the contrary."
